Terms of Service

By accessing or using the $ertified$tackers platform, website, mobile applications, physical retail experiences, community events, and any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

These Terms may be updated from time to time. Continued use of the Services after any change constitutes acceptance of the revised Terms.

You must be at least eighteen (18) years of age to create an account or purchase from the Services. By creating an account you represent and warrant that you are 18 or older and legally capable of entering into a binding contract in your jurisdiction.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Membership tiers (Stacker, $ertified Stacker, Royalty) are computed from cumulative eligible spend and community activity. Tiers may be adjusted at the sole discretion of $ertified$tackers, and $ertified$tackers reserves the right to override, promote, or demote tiers to enforce the integrity of the community.

Tier benefits (early access, founding-preview windows, elevated $TACK earn rates, and event perks) are subject to change without prior notice.

$TACK is an internal loyalty and utility credit issued by $ertified$tackers. $TACK is not a currency, security, commodity, cryptocurrency, or investment product. $TACK has no cash value outside the $ertified$tackers ecosystem, cannot be redeemed for cash, cannot be transferred between users, and cannot be sold or traded on any secondary market.

$ertified$tackers reserves the right, in its sole discretion, to adjust earn rates, redemption values, caps, and reward mechanics at any time. $TACK may be forfeited on account termination for fraud, abuse, chargeback misuse, or violation of these Terms.

Certain limited-edition apparel pieces confer daily $TACK accrual to the registered owner. Eligibility for daily accrual requires all of the following:

• The piece is authentic and purchased from an authorized source.
• The serial number is registered to your active account.
• Your account is in good standing (no active suspension or fraud flag).
• The piece has not been reported lost, stolen, refunded, or resold.

Full refunds, chargebacks, or resale outside brand-facilitated channels will deactivate the piece’s eligibility. Partial refunds may or may not deactivate eligibility depending on the circumstances, at the brand’s discretion.

All prices are listed in United States Dollars (USD) unless otherwise stated. Availability of any item is not guaranteed and may be withdrawn at any time. $ertified$tackers reserves the right to refuse or cancel any order for any reason including but not limited to: suspected fraud, pricing errors, stock unavailability, or violation of these Terms.

Shipping timelines and rates are estimates and not guaranteed. Title and risk of loss transfers upon delivery to the carrier.

Tickets to $ertified$tackers events are non-transferable except through a brand-facilitated resale mechanism (where offered). Attempting to transfer, sell, or gift tickets outside of the brand platform may result in the ticket being invalidated without refund.

Tickets reported as lost, stolen, or refunded are automatically invalidated. $ertified$tackers reserves the right to deny entry to any person for reasons including but not limited to: dress code, behavior, capacity limits, or presentation of an invalid ticket.

When you post photos, videos, comments, or other content (“User Content”) to the $ertified$tackers community feed, you retain ownership of that content but grant $ertified$tackers a worldwide, non-exclusive, royalty-free license to use, display, reproduce, distribute, and create derivative works of your User Content in connection with promoting the brand, the community, and the Services.

You are solely responsible for your User Content. Prohibited content includes: unlawful, hateful, harassing, sexually explicit, defamatory, infringing, or spam material. $ertified$tackers may remove any User Content at its sole discretion.

$ertified$tackers and all associated logos, wordmarks, designs, product designs, drop names, and brand assets are the property of $ertified$tackers or its licensors. You may not copy, reproduce, or create derivative works from any brand asset without prior written consent.

$ertified$tackers may suspend or terminate your account and/or access to the Services at any time for violation of these Terms, suspected fraud, chargeback abuse, hostile or abusive behavior toward staff or other members, or for any lawful reason.

On termination for cause, any $TACK balance and any limited-edition eligibility may be forfeited. Purchased physical goods remain yours, subject to the Refund Policy.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, $ERTIFIED$TACKERS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO $ERTIFIED$TACKERS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles. [Placeholder — confirm with counsel.]

Any dispute arising out of or relating to these Terms or the Services shall be resolved through final and binding arbitration on an individual basis in Los Angeles, California, in accordance with the rules of a mutually-agreed arbitrator.
